경기도 안양에 사는 B 씨도 황당한 일을 겪었다. 1990년대 건축한 오래된 집을 인테리어 맡긴 지 1년이 지났는데 아랫집에서 누수로 연락이 왔다. 알고 보니 1년 전 공사를 진행한 C 씨가 선반을 다는 과정에서 화장실 하수도 배관까지 뚫어 버린 것이다. C 씨는 “오래된 집이라 어디에서 문제가 생길지 알 수 없다”며 “운이 나쁠 뿐 내 잘못이 아니다”고 잘라 말했다. A 씨는 전전긍긍했지만 공사 후 1년이 지나 법적 책임을 물을 수도 없다는 주변의 말에 절망해야 했다.
리모델링 시대다. 한 집 건너 한 집 뜯어고친다고 해도 과언이 아닐 정도다. 수요가 늘다 보니 가격도 올랐다. 인테리어 정보 업체인 ‘오늘의 집’에 따르면 112㎡(34평)형 리모델링 가격의 인테리어 비용은 2019년 3400만원에서 2021년 4750만원으로 뛰었다. 3.3㎡당 150만원에 가까운 비용이다. 그런데 수천만원의 비용을 지불하고 인테리어를 맡긴 소비자들이 뿔났다. 인테리어 사업자들이 계약금을 받고 잠적하거나 부실 시공으로 인한 피해가 급증하고 있기 때문이다.동탄인테리어업체한국소비자원에 따르면 인테리어 설비 관련 소비자 상담은 2014년부터 매년 4000여 건 이상 접수되고 있다. ‘공사 지연’은 물론 ‘부실 공사로 인한 하자 발생’, ‘계약 내용과 다른 시공’, ‘하자 보수 요구 사항 미개선’, ‘계약 취소 등 계약 관련 분쟁’ 등이 주요 민원 내용이다. 유튜브·네이버 등 주요 커뮤니티에 상담을 신청하는 글만 봐도 인테리어 부실 공사로 눈물을 흘리는 피해자들의 사연을 쉽게 접할 수 있다. 상황이 이렇다 보니 소비자 사이에서는 “인테리어 할 때 무조건 상주하고 감시해야 한다”는 조언이 ‘꿀 팁’으로 돌 정도다. 전문가들 역시 “법을 악용할 수 있는 사각지대가 많아 소비자들은 바가지를 쓰거나 뒤통수를 맞을 수밖에 없는 구조”라고 설명했다. 왜, 이런 문제가 지속 반복되는 것일까.
형법 제 347조(사기)에는 ‘사람을 기망하여 재물의 교부를 받거나 재산상의 이익을 취득한 자는 10년 이하의 징역 또는 2000만원 이하의 벌금에 처한다’고 규정한다. 단, 사기죄가 성립되려면 상대방이 애초부터 기망 행위 등을 했다는 증거가 있어야 한다. 단순히 인테리어를 기한 내 끝내지 못했다는 것만으로는 고의성을 판단하기 어렵기 때문에 사기죄로 고소하기 어렵다는 것이다. 민사 소송을 통해 상대방에게 손해 배상 등을 청구할 수 있지만 이 역시 손해를 증명하는 부분에 따라 달라질 수 있다. 설령 민사 소송을 진행한다고 해도 계약금의 경우 대금의 10~30%로 몇 백만원일 경우가 높기 때문에 변호사 수임료를 제외한다면 남는 금액도 없다. 과실 입증, 변호사 선임비, 소송 비용 청구 등 진행 비용도 만만치 않고 거주 공간의 특성상 오랜 시간을 투자할 수도 없다. 인테리어 사업자들 일부가 이러한 사각지대를 이용해 철거하고 자재를 갖다 둔 후 잠적하거나 공사를 차일피일 미루는 것이다.
전문가들은 ‘인테리어 공사 계약서’의 중요성을 강조한다. 계약서 작성과 계약금 납부를 전후로 갑과 을의 위치가 완전히 뒤바뀌기 때문이다.
전문가들이 조언하는 인테리어 부실 공사 피해를 막는 방법은 다음과 같다. 첫째, 사업자 등록증을 반드시 확인해야 한다. 기본 중 기본이지만 이를 망각해 피해를 보는 일이 잦다. 악덕 인테리어 업체는 유명한 업체와 사명을 비슷하게 만드는 곳이 많다. 국토교통부 산하 건설산업지식정보 시스템인 ‘키스콘’에서 건설 업체 정보 조회를 통해 반드시 사업자 등록증을 확인하자. 이때 업체명이 여러 번 바뀌었거나 사업자등록증상 대표자 명의와 입금 계좌 명의가 다르면 주의할 필요가 있다.
또한 공사 비용이 1500만원 이상이라면 실내건축공사업 면허가 반드시 필요하다. 관련 법에 따라 면허 없이 시공할 수 없으므로 면허 발급 업체에서 시공해야 한다.
둘째, 계약서 작성 시 반드시 넣어야 할 문구를 확인하고 기입한다. 포털 사이트에 검색되는 통상적인 계약서로는 법의 사각지대를 피할 수 없다. 업계 관계자는 “일률적인 계약서로는 상황에 따른 현장 상황을 반영하기에 한계가 있다”며 “추가적인 규정을 계약서에 넣어 반드시 사기 피해를 방지해야 한다”고 말했다.
